BOULDER TOWNSHIP JUSTICE COURT, MUNICIPAL COURT, DISTRICT COURT AND NEVADA SUPREME COURT

 

The following cases involve the City of Boulder City and key governmental operations:

 

*Judge Scann’s decision of March 31, 2011 to sanction Boulder City regarding their violation of Rule 11 on judicial conduct against the defendants of the term limits ballot question.

 

1. Plaintiff/ Boulder City violated Rule 11 . . judicial conduct in splitting the lawsuit into 3 separate cases.    Fined: $10, 000.00 and $925.49 for court costs.  

2.  This case will be consolidated with Judge Tao's decision. . . .Debt Limit and now Term Limits to go to Supreme Court.

3.  Judge Scann did not order the City to pursue Chapter 43 where the district court (without named defendants) can determine if the ballot questions are legislative or administrative.

4.   Defendants can be dismissed if they choose. . . less Jensen who is included in all three, now two cases going forward to the Supreme Court.

*The three SLAPP motion appeals on debt limit, term limit and one golf course have been certified by the District Court judges involved and will be heard before the Nevada Supreme Court in December 2011/January 2012.

*Case # A-10-629988-C, ( Debt Limit) to be heard on January 20, 2011 at 9 am in Department 20 of the Las Vegas District Court, names James C Douglass, Frank L. Fisher, Cynthia Harris, Daniel D. Jensen and Walt Rapp as defendants. The attorney of record for Boulder City is City Attorney David R. Olsen.   Defendants’ reply to motions on Debt Limit.

 

*Case # A-10-629989-C, (Term Limits) to be heard on January 21, 2011 at 9 am in Department 29 of the Las Vegas District Court, names Linda F. Henry-Schrick, Daniel D. Jensen, Norbert Kastl, James Douglass and Nancy A. Nolette as defendants. The attorney of record for Boulder City is City Attorney David R. Olsen.  Defendants’ reply to motions on Term Limits.
